General tenancy conditions and terms of business

Dear guest, 

the following terms and conditions regulate the contractual relationship between you as tenant of our holiday flat and us, the Goorer Berg GmbH. By sending us your booking form you accept our terms and conditions.

1. Booking and Tenancy Agreement

1.1 You can make your booking application in writing, verbally or by telephone.
We confirm your booking by sending you the booking confirmation and the tenancy agreement. When you sign the tenancy agreement, this agreement (including these terms and conditions) comes into effect and becomes binding on both you and us.
1.2 The person who signs the tenancy agreement takes responsibility for the contractual obligations of all persons named in the tenancy agreement. 
1.3 If the details of the booking confirmation which we send you differs from your booking application, by signing the tenancy agreement you accept the details as they appear in our booking confirmation.
1.4 The flat may only be inhabited by those persons who are listed in the tenancy agreement. In some flats it may be possible to supply additional beds on request.
1.5 Pets are only allowed if you have notified us in advance and we have given our consent.

2. Payment

2.1 When you conclude the tenancy agreement you are required to pay a deposit equivalent to 20 % of the rent.
2.2 The remaining 80% of the rent is payable 28 days before your arrival. If you are renting at short notice you are required to pay the entire rent as soon as you receive the tenancy agreement. 
2.3 If you book with us on more than one occasion we may grant you an individual price reduction on subsequent bookings, set by us.
2.4 If you book your holiday flat more than 6 months in advance you receive an early-booking rent reduction (about 15.- € per booking).
2.5 If you have not paid the full rent 8 days before arrival  this is seen as a cancellation. In this case we can claim an adequate cancellation fee as compensation (cf. No. 5).

3. Our performance

3.1 The details of the applicable price list and of your tenancy agreement apply to our performance of the agreement during the booking period.
3.2. In the case of force majeure or other circumstances for which we are not responsible we may give you another equivalent or superior flat as a substitute.

4. Cancellation, Change in Booking, Change in Tenant

4.1  You may – if possible in writing – withdraw from the tenancy agreement at any time. Your cancellation will take effect from the day on which we receive  it.
4.2 If, for reasons for which we are not responsible, you do not set off on your journey this is deemed equivalent to a cancellation.
4.3 We demand indemnification for expenses incurred by us as a result of such cancellation. In calculating the indemnification we will take into account, if applicable, the fact that we have found another tenant for the flat. 
4.4 We demand the following indemnification (cancellation fees):
- If you cancel 29 days or more before the start of the tenancy we charge a lump sum of € 52.- as indemnification for advertising to alternative guests.
- If you cancel 28 to 15 days before the start of the tenancy we charge 50 % of the rent.
- If you cancel after the 15th day before the start of the tenancy we keep the entire rent in case no other tenant is found.
If the new tenant pays a lower rent than the rent due from you we charge you the difference as well as  an indemnification for our expenses. 
4.5 Up until the date of arrival you may demand that a third person assumes your rights and duties under the tenancy agreement. It is necessary to inform us in writing (change in booking).
4.6 When we confirm the change of tenant the new tenant assumes your rights and duties under the tenancy agreement. We will charge you a lump sum of € 21.- in respect of the necessary confirmation of change of tenant.
4.7 We advise you to take out holiday cancellation insurance with your insurance firm within one week of receiving  the tenancy agreement.

5. Cancellation by us

5.1 We can cancel the tenancy agreement without advance notice if, despite having been warned by us, the tenant or any other occupant behaves in a manner which causes disturbance or destruction and if this person’s continued presence is in our view unacceptable for other guests.  In this case we continue to be entitled to the rent.
5.2 We can cancel the tenancy agreement if its performance is substantially diminished, made more difficult or made dangerous by reason of force majeure (e.g. through war, civil unrest, natural disasters, fire etc.). We will then immediately pay back the amount of rent which we have received, but we may demand adequate indemnification for any performance of the agreement provided by us as well as expenses incurred.

6. Guarantee

6.1 If we do not perform adequately or at all under the tenancy agreement you may demand that we remedy  the situation within a reasonable period.
6.2 If we cannot remedy the situation we may negotiate a reduction in rent with you.  We ask you to inform the caretaker immediately if there are any reclamations, technical defects or damage to the installation system.
6.3 If your stay is affected substantially by a defect and if we do not accomplish remedy within a reasonable period you may give notice in writing. You then owe us a proportion of the rent in relation to the performance which you received, as far as such performance was of interest to you. 

7. Liability

7.1 Our contractual liability for any damage which is not physical injury is limited to an amount equal to three times the rent, provided that we did not cause such damage intentionally or in a way that is grossly negligent.
7.2 The person who signs the tenancy agreement is responsible for taking adequate care of the flat and for any damage caused to the flat or its contents.

8. Asserting claims

Claims arising out of the tenancy agreement which  could not be dealt with in situ must be taken up with the  Goorer Berg GmbH, Mrs Almuth von Groote, Brandberg 6, 28790 Schwanewede within one month of the end of the tenancy.  If this is not done such claims will expire. For your own benefit you  should submit your claim in writing. Claims relating to inadequate or non-performance of the agreement expire in any event six months after the end of the tenancy. Claims arising out of tort expire after three years.

9. Handover and Use of the Flat

9.1 Handover of the flat takes place between 15  p.m. and 18 p.m. on the day of your arrival. It is possible to arrange a different handover time by advance agreement. We ask you to vacate the flat by 10 a.m. on the day of your departure. The caretaker will take back the keys to the flat from you.
Your arrival and departure days together count as one day.
9.2 On the arrival day at the handover of keys  we may demand a deposit of € 100.- to cover possible expenses and damage caused to the flat or its contents. The deposit, minus any appropriate deductions, will be returned to you on the day of your departure. Returning the deposit is without prejudice to any claims we may have in relation to damage which was not immediately apparent.
9.3 By reason of local law we are obliged to collect from our guests the regional health resort tax and to pass it to the local council of Putgarten. We will inform you of the amount of health resort tax which applies at the relevant time.
9.4 The flat must be left tidy. Cleaning equipment is available. We carry out the final cleaning. If the flat is in a worse condition than could reasonably be expected we may demand from you an additional fee in respect of cleaning expenses.
